After two court judgements against them, a short rail line made a third attempt in court to block a field with great action from the town of Granite Falls.

Laws around the allocation of the pool is being reviewed for the first time since it entered into force, 20 years, Building and Construction Minister Brian Jones announced today.
The revision of the law in order to change aimed at improving the safety of the pool.
Mr. Jones said, the average number of children under the age of six, drowned in swimming pools each year has been reduced by nearly two-thirds of fencing since the law on pools has been set up during the year 1987.
But death was one too many, he said.
In the seven years before the law came into force, 81 children drowned in swimming pools, an average of 11.5 per year.
The average of the past seven years, he has four.
Water Safety New Zealand 193 children showed figures are drowned in swimming pools since 1980.
Of this amount, 84 per cent of private pools drowned.
Mr. Jones said, the decline in the number of drownings of children was significantly taking into account the estimated number of private swimming pools was 30 percent in the last ten years - in the order of 55600 to nearly 73700th
He wants to release a consultation paper as part of an assessment of the law on Monday.
“It appears that some of these deaths still occur can be prevented by fencing. It follows the need to consider changes to the law, an improvement of the compliance and enforcement,” said Jones.

– Improved uniformity and territorial integrity of the authorities of interpreting and applying the law;
– The provision of greater security grouping owners and local authorities on their duties and obligations under the law;
– Strengthen public awareness for the owners of the pool of liability under the law.

THERE’S AN OLD ADAGE claims that a man’s (or woman’s) home is his (or her) castle. But when your home is a condo, your castle is directly attached to many of the other royal families, it has people. So, it’s not as easy to rule the way your perch could you on, say, a 10-acre spread. In close quarters, you may find that your neighbors do not like listening to your Metallica CDs any more than you enjoy hearing them in the midst of their romantic conquests.
In her book “The Condo Owner’s Answer Book” ($ 17, Sphinx Publishing), real estate by Beth A. Grimm tries to help buyers such sleep easier. She delves into issues ranging from noise control to neighborhoods. We chatted with her recently.
“EXPRESS: What people should consider before buying a condo in this market dropping?
“GRIMM: One of the biggest things people need to be wary of squeezing if it is in on a mortgage, there are likely to be coming increases in assessments in many associations mortgage because of the crisis. It’s more forcing people out of their homes, and other owners in associations with lots of foreclosures are going to have to pick up the difference in money lost in assessments. So, the biggest concern [for buyers] is making sure they have a little financial cushion.
“EXPRESS: What are the advantages to owning a condo?
“GRIMM: The advantages of a condo are great. It’s lock-and-go living. You have to do outdoor maintenance. There are more people around, so, if you leave, it’s normally a safer situation because there are people milling around and look like it is there’s a vacant home. There are more amenities than usually you can afford in a home.
“EXPRESS: So, what’s the downside?
“GRIMM: You have complete control over your finances. It’s possible that your money could be mismanaged by volunteers. You have to pay the mortgage assessments more, and you are subject to market fluctuations more on building costs because you are more involved in the construction - it’s not just on your home but on the homes of others sharing the costs.
“EXPRESS: What does a condo association do?
“GRIMM: Its role is to collect your money and spend it to manage the property. Some boards do it a lot better than others. They have a difficult role, because they charged with running a business oftentimes without specific training.
“EXPRESS: What’s covered by the condo fees, and what do I have to cover myself?
“GRIMM: Usually the owner is responsible for the interior of the unit, which would mean flooring, wall coverings, furniture and their personal belongings. It could be just the air space, and it could be that the association does everything else. But it’s possible that the owner could be responsible for window replacement. Generally, the association is responsible for the maintenance.

CANYON LAKE —- cormorants have returned, but they can see better backs.
Every year in late January, from the end of May, 383 acres, the lake in the middle of the gated community of Canyon Lake is the home of hundreds and sometimes thousands of cormorants, birds feeding on fish, gobble up the lake’s and Bass Armies to hang on the lake-islands.
During the last week, the weather has improved, more people Canyon Lake, sea fishing or walking on the golf course, birds are susceptible, “said Paul Johnson, Director of Operations for the community owners association.
Canyon Lake is a city, but the Association of sleeves road repairs and maintenance of the organisation doors of the Development, 40, a draft Code of functions champion, the 14 miles of shoreline of the lake.
On Friday, Johnson said he was about cormorants at 1500 Canyon Lake.
While some people complain about the debt for birds a fish population exhausted, Johnson said, it has not caused a big problem.

Johnson said that the resolution was adopted in part because the cormorant 2005 season, the lake was harassed by 6000 birds.
Looking for a way to start the aufsässigen soaked cormorants, the club belongs California Department of Fish and Game officials. (A group of cormorants is called “swallowing,” said the San Diego Zoo’s Web site.)
Johnson said that the birds, protected by the federal law Zugvogels contract, which means that there is no private or public agency can be lethal methods of control over the birds, without the permission of the Confederation.
Fish and Game officials, of the association, there are no rules, which prohibit harassment, for the birds to fly somewhere else.
