In a 2-to-1 ruling that runs counter to the Reagan Administration’s program of drug testing, the United States Court of Appeals for the Ninth Circuit said that such testing of any of the nation’s 200,000 railroad workers was not justified simply because a worker was on a train crew that got into an accident or went too fast.
